The following terms and conditions of service (these "T&Cs") govern your access to and use of the www.AlexPabo.com and the mobile application, including any content, functionality and services offered on or through www.AlexPabo.com or the Alex Pabo (the "Site") by Pacheco Barroso (SU) Ltd. and its subsidiaries (hereinafter PB) as applicable.and PB its subsidiaries are collectively referred to as "PB" "we" and "you", "customer", or "user" means you as a user of the Site.
Please read the Terms and Conditions of Services carefully before starting to use the Site. By using the Site, opening an account or clicking to accept or agree to the Terms and Conditions of Service when this option is made available to you, you accept and agree to these Terms and Conditions on your behalf or on behalf of your employer. You also acknowledge that you have read and understood our Privacy Policy, found here. If you do not agree with these Terms and Conditions of Service or the Privacy Policy, you must not access or use PB. For more detailed policies on the activity and use of the Site, please read the articles designated here.
This Site is only available to persons over the age of 18, with the exception of persons under the age of 18 who have parental or legal guardian permission and supervision. By using the Site, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

The original language of these Terms and Conditions of Service is Portuguese. PB provides translations for convenience only. In case of conflict between the original Portuguese version and any translation, the Portuguese version will prevail.
How it works
Overview (key terms in a nutshell)
Only users residing in countries where the services are offered and providers approved by the relevant PB can buy and sell on the Alex Pabo platform. Navigating the platform as well as requesting a service is free. By using the platform and/or requesting a service, you agree to provide us with accurate, complete and up-to-date information and must not do so for fraudulent or deceptive purposes.
You are solely responsible for any activity on your behalf and for maintaining the confidentiality and security of your financial data. We are not responsible for any acts or omissions on your part in connection with your use.
The Artworks on the platform are made available for transactions at a price agreed between PB and partner suppliers. PB and its subsidiaries and its websites are only intermediaries, the partner supplier is responsible for the quality and delivery of the artwork.
How the user can request a service - Users browse the platform, identify a work of art they want, read the details and follow the necessary steps to execute the desired transaction. (It will be necessary to provide some personal data such as, but not limited to, first name, surname, date of birth, ID number, mobile number, email, and potentially others). By placing a private order, clients understand that this order is placed with PB and that PB is the entity holding the Intellectual Property that arises from this private work.

Existing works of art

If the required artwork is available, users receive a pro-forma invoice by email/whatsapp/message and have a set time to pay the invoice and send the proof. With the proof sent, Alex Pabo sends a confirmation. If the stipulated time for payment has passed, we may have to re-confirm the availability of the word chosen. If the customer makes the payment after the stipulated time and the work requested is no longer available we will do our best to suggest an alternative work, if accepted the platform team will send you a confirmation. If the customer does not accept, a refund of the amount paid is made within 15 working days.

Private (commissioned) works of art

Once a user makes a request and we confirm with one or more artists (at least one) their availability to execute the work being commissioned (in line with the specificities given by the user) an equal number of pro-forma invoices will be sent to the costumer (this we expect to be done within 3 working day). Users receive the pro-forma invoice(s) by email/whatsapp/message and have a set time to pay the invoice they want to accept and send the proof. With the proof sent, Alex Pabo sends a confirmation and only then will work begin. Upon payment and the start of the work any change request will be subject to a review by the Alex Pabo team and the artist who will decide if it’s plausible to execute it as it may not be artistically feasible, may impact the delivery schedule of other commissioned work, or any other reason. If a change request is accepted there will be extra charges for it priced at at least 15% of the price paid for the commissioned work to account for things such as but not limited to: any extra time required, any new material required, admin costs, and the impact on delivery of other artwork. Change requests may also impact the delivery time of the artwork and the user will be informed of the new time when the pro-forma invoice is sent.

How to receive your work of art – For receiving the work in Luanda, Angola we can arrange home delivery together with the partner supplier, we will do our best to deliver within 1 week. Alex Pabo will return your order to its offices if we spend more than 15 minutes looking for the delivery location or if the customer is unreachable. The customer will have one day to pick up the order during our working hours. After this period, we are not responsible for any damage to the order. Alternatively, the buyer can collect the work from our offices within 2 working days from completion. After this period, we are not responsible for any damage to the order. If it is in another province or in another country, the transport of the work is the responsibility of the buyer, who will organize the collection of the work with our team.
Complaints and non-receipt of service - Any complaint must be communicated by the end of the day (11.59pm) on which you receive the artwork via email to geral@pachecobarroso.com with the subject: “[Invoice number] Complaints” and in the email body all details. We will do our best to help. The customer must know that the partner supplier is solely responsible for the artwork they supply and not PB and its subsidiaries. Partner vendors with repeated complaints or serious eventualities may be banned from the platform. However , it is the customer's sole responsibility to initiate this claim process.
Returns - To avoid possible counterfeits, we only accept returns of works of art that are in our custody. That is, either in the process of delivery in Luanda by our team or in the process of collection from our offices by the customer. The return request must be made when the work is being delivered and before the customer has signed an acknowledgment of receipt. 10% of the purchase price will be retained to cover administrative costs (e.g., transport). For commissioned work there are no refunds once payment is done as materials are bought and work starts unless: the work is damaged when delivered (if that is NOT in line with the client’s specification) and the client does not accept to keep it as is; it doesn’t pass the review of the Alex Pabo team once completed; or it is delivered later than the stipulated time for reasons other than acts of god, death/illness of the artist and unavailability of material to deliver the commissioned artwork.
Customer Cancellations - It is possible that in some instances customers will have to cancel the purchase made. This process must be done within 12 hours after payment for the work. After these 12 hours, the returns process follows.
Vendor Cancellations – In some instances partner vendors may have to cancel. The platform Alex Pabo does its best to provide the customer with an acceptable alternative. If the alternative is not found, a refund of 100% of the amount paid by the customer is made.
Legal liability - Users and supplier partners cannot hold PB or any member of the company responsible for problems with the works provided by suppliers or for financial losses resulting from the provision of works defective by the suppliers.
The site aims to be an exchange tool between the supplier and the final consumer, in the discovery of new works of art. The quality and guarantee of services is the full responsibility of the partner supplier.
PB is not responsible for any problems or technical malfunctions of any telephone or line and on-line computer systems, servers, or vendors, computer equipment, software, e-mail failure or technical problems or internet traffic congestion.
PB expressly disclaims any responsibility or liability whatsoever resulting from any content of study material made available to subscribers.
does PB not warrant that all information is accurate, and disclaims any and all liability to any person for any loss or damage caused by errors or omissions, whether such errors or omissions result from negligence, accident or any other cause.the PB interpretation and/or use of information contained on the website, nor does it offer any express or implied warranty of any kind.
Some Basic Notes

To protect our users' privacy, their identities are kept anonymous. In most cases, our partner providers only receive an identifier that names your invoice or service. Requesting or providing email addresses, Skype/IM usernames, phone numbers or any other personal contact details to communicate outside the Alex Pabo in order to circumvent or abuse the system we have established is not allowed.

PB and its subsidiaries do not guarantee the level of work offered to purchasing users.

PB does not provide support for users who interact outside the rules of use of the platform.

Rude, abusive, inappropriate or violent language will not be tolerated and may result in a blocking or blocking notice from the user or partner provider.

PB is open to all. You undertake not to discriminate against any user or partner provider based on sex, race, age, religious affiliation, sexual orientation or other parameters and you acknowledge that such discrimination may result in your being blocked from the Alex Pabo platform.

Partner providers or users may not submit proposals or request that third parties submit or pay outside the means of payment indicated by the Alex Pabo platform team.

All services within the Alex Pabo undergo a rigorous evaluation process. Our team does its best to ensure that only suppliers of works are listed on the platform. We reserve all and complete rights to decide which works are made available within the platform. If there is a work provided of low quality, please let us know via geral@pachecobarroso.com with the subject: “[Invoice number] Quality”. We also expect acceptable and respectful behavior towards our partners, their employees, and PB our potential customers. If we receive consistent complaints of vandalism and other illegal acts, we reserve the right to ban these individuals from using our platform. Partner suppliers can also make their complaints to geral@pachecobarroso.com with the subject “[Invoice number] Quality”.
USER
THE PB allows Users to submit content in different areas of its Websites. By submitting content, the User is declaring that he is the sole and exclusive holder of the associated rights and that he authorizes PB to disseminate said content in the publication he deems most appropriate and for any and all available media. The User will remain the owner of the content that he submits to PB, and by sending the contents, the User will be granting PB a license, free of charge, irrevocable, transferable, non-exclusive and perpetual for the use of said contents as well as for transmitting or licensing them to third parties, in any support or format. currently on the market or that may emerge.
The User guarantees that the content submitted on our Websites is not obscene, offensive or gives rise to civil or criminal liability and does not violate the intellectual property rights of third parties. The User is solely and exclusively responsible for all content that he/she publishes on PB, namely, the comments that he/she makes in forums, the messages that he/she transmits or any other content that he/she intends to share. If you intend to actively participate in forums, comment on our articles or the opinions of our readers, you should keep in mind that these spaces are essential for the free dissemination of opinions and ideas, but mutual respect and urbanity are factors that cannot be forgotten. The User acknowledges that PB is not obliged to monitor, edit or preview the content or comments that are shared by Users on its Websites.
However, the editorial offices of the various media owned by PB reserve the right not to publish comments on their websites that they consider to be, in particular, racist, xenophobic, offensive or defamatory or that, in general, do not contribute to the clarification, debate or discussion of topics. All comments or contents that may be shared by the user on PB constitute the opinion of their author, who are only linked to him and do not reflect the opinion or position of PB. The fact that content broadcast by a User or third party has been broadcast on PB does not presuppose that the user has had any prior knowledge of it, much less that he agrees or supports its content. For all legal purposes, it is assumed that PB and the members of the editorial offices of the various titles are unaware of the content shared by third parties and Users on these Websites.
The User undertakes, in particular, not to use the PB for: (i) commercial purposes, namely, spreading advertising messages in the comments or in other spaces, outside those specifically intended for advertising contracted under the appropriate terms; (ii) disseminate content of hate or discrimination or that, in general, encourage violence or the practice of illegal acts; (iii) disseminate content that aims, solely and exclusively, to humiliate, denigrate or harm the good name and reputation of third parties.
INTELLECTUAL PROPERTY OF THE CONTENT ON OUR WEBSITES
All content available on the Websites is and remains the property of PB. The User is not authorized to: (i) remove or use any indication of intellectual property, including, but not limited to, trademark or other intellectual property notices from any content on PB; (ii) reproduce, modify, make derivative works, distribute, license, rent, sell, resell, transfer, publicly display or present, transmit, reproduce, broadcast, or in any other way exploit the contents of the PB, except to the extent as expressly permitted in writing by PB; (iii) create links or reproduce through "frames" any proprietary content or content made available on PB; (iv) create or launch any programs or scripts to capture, index, collect or, in any other way, extract content from PB, or unduly overload and/or make impossible the operation and/or functionality of the Websites; or (v) attempt unauthorized access to said content, reserved areas and personal accounts or harm any aspect of the content of PB.
